This Privacy Policy explains how Clearpoint collects, uses, stores, and protects information in connection with our services. By engaging Clearpoint, you agree to the practices described below.

Information We Collect

Clearpoint collects information in the course of providing marketing services to clients and through interactions with our website. The types of information we may collect include:

  • Business Information: Business name, address, phone number, website, service areas, hours of operation, and any other details necessary to deliver marketing services
  • Contact Information: Name, email address, phone number, and title of the individual engaging our services or communicating with our team
  • Payment Information: Billing details processed through our third-party payment processors. Clearpoint does not store full credit card numbers or banking information directly.
  • Account Credentials: Login access to platforms such as Google Business Profile, Google Ads, Meta Business Suite, and website admin panels, provided by the Client solely for the purpose of delivering services
  • Communications: Emails, messages, notes, and other correspondence between the Client and Clearpoint
  • Website Usage Data: IP address, browser type, device type, pages visited, and time spent on our website, collected via cookies and analytics tools
  • End-Customer Data: Lead and contact information generated through campaigns we manage on behalf of clients, which belongs to the client and is handled in accordance with this Policy

How We Use Information

Clearpoint uses the information collected solely to operate, deliver, and improve our services. Specific uses include:

  • Setting up, managing, and optimizing marketing campaigns and accounts on behalf of the Client
  • Communicating with the Client regarding services, updates, performance reports, and billing
  • Processing payments and maintaining billing records
  • Fulfilling contractual obligations as outlined in the applicable Service Agreement
  • Improving our internal processes, tools, and service quality
  • Complying with applicable legal obligations
  • Protecting the rights, property, and safety of Clearpoint, its clients, and the public

We do not sell your information. Clearpoint does not sell, rent, or trade any client or end-customer information to third parties for their own marketing or commercial purposes.

Information You Provide to Us

When you contact Clearpoint, complete an intake form, book a strategy call, or sign a Service Agreement, you voluntarily provide information that we use to deliver and manage our services. This includes but is not limited to:

  • Information submitted through contact or booking forms on our website
  • Business details, goals, and marketing history shared during onboarding or strategy calls
  • Content, photos, logos, and brand assets provided for use in campaigns or website builds
  • Login credentials and platform access granted for service delivery purposes

You are responsible for ensuring that any information or materials you provide to Clearpoint are accurate and that you have the right to share them. Clearpoint assumes no liability for inaccurate or unauthorized information provided by the Client.

Third-Party Services & Platforms

Clearpoint uses third-party platforms and tools to operate and deliver services. These may include GoHighLevel (GHL), Google Workspace, Google Ads, Meta Business Suite, Stripe or other payment processors, and scheduling or communication tools. Each of these platforms has its own privacy policy and data practices, which are independent of this Policy.

  • Clearpoint is not responsible for the data practices of any third-party platforms or tools
  • By engaging Clearpoint's services, you acknowledge that certain information may be processed through these platforms as part of normal service delivery
  • Clearpoint will only share the minimum information necessary with third-party platforms to fulfill the services contracted
  • Clearpoint is not liable for any data breach, loss, or misuse that occurs at the third-party platform level

Cookies & Tracking Technologies

Our website may use cookies, pixels, and similar tracking technologies to improve user experience, analyze site traffic, and support marketing efforts. This includes:

  • Essential Cookies: Required for the website to function properly, including form submissions and page navigation
  • Analytics Cookies: Used to understand how visitors interact with our website (e.g., Google Analytics). Data collected is aggregated and anonymized.

For Clearpoint clients: We may install tracking pixels or tags on client websites as part of campaign management. All such installations will be disclosed to the client and are governed by the applicable Service Agreement.

Data Retention

Clearpoint retains client information for as long as necessary to fulfill the purposes outlined in this Policy, comply with legal obligations, resolve disputes, and enforce agreements.

  • Active client records are maintained for the duration of the Service Agreement and for a reasonable period thereafter for accounting and legal purposes
  • Payment and billing records may be retained for up to seven (7) years in accordance with standard accounting and tax requirements
  • Communications and correspondence may be retained for up to three (3) years following termination of services
  • Upon request and following termination of services, Clearpoint will make reasonable efforts to delete or anonymize personal data that is no longer needed, subject to legal retention requirements

Data Security

Clearpoint takes reasonable and industry-standard measures to protect the information we collect and maintain against unauthorized access, disclosure, alteration, or destruction.

  • Access to client accounts and information is limited to team members who require it to perform their role
  • We use secure, password-protected tools and platforms for storing and managing client data
  • Payment information is processed through encrypted, PCI-compliant third-party payment processors

No method of transmission or storage is 100% secure. While Clearpoint takes reasonable precautions, we cannot guarantee absolute security. Clearpoint is not liable for any unauthorized access or data breach that occurs despite these measures, particularly those originating from third-party platforms or client-side vulnerabilities.

Sharing of Information

Clearpoint does not sell, rent, or share client information with third parties for their own commercial purposes. We may share information only in the following limited circumstances:

  • Service Delivery: With third-party platforms and tools (e.g., GoHighLevel, Google, Meta) solely as needed to deliver contracted services
  • Contractors and Subcontractors: With trusted individuals or agencies engaged by Clearpoint to assist in service delivery, who are bound by confidentiality obligations
  • Legal Compliance: When required by law, court order, or governmental authority, or to protect the rights and safety of Clearpoint, its clients, or the public
  • Business Transfer: In connection with a merger, acquisition, or sale of assets, in which case clients will be notified in advance
  • With Your Consent: In any other circumstance where the Client has provided explicit written consent

Your Rights

Depending on your location and applicable law, you may have certain rights regarding your personal information. These may include:

  • Access: The right to request a copy of the personal information Clearpoint holds about you
  • Correction: The right to request that inaccurate or incomplete information be corrected
  • Deletion: The right to request deletion of your personal information, subject to our legal retention obligations and active contractual commitments
  • Opt-Out of Communications: The right to opt out of marketing or promotional communications at any time by contacting us directly or using unsubscribe links provided in emails
  • Data Portability: The right to request that your data be provided in a commonly used, machine-readable format where technically feasible

Children's Privacy

Clearpoint's services are intended for business owners and professionals and are not directed at individuals under the age of 18. We do not knowingly collect personal information from anyone under 18 years of age.

SMS & Email Communications

By providing your phone number or email address to Clearpoint, you consent to receive communications related to your services, account, and business relationship with us. This includes:

  • Service updates, onboarding instructions, and performance reports
  • Billing notifications and payment confirmations
  • Promotional or informational messages about Clearpoint offerings, where you have opted in

Opt-Out: You may opt out of marketing communications at any time by replying STOP to any SMS, clicking the unsubscribe link in any email, or contacting us directly. Transactional messages related to active services may not be opted out of while a Service Agreement is in effect.

For clients using Clearpoint-managed SMS or email automation through GoHighLevel or similar platforms, those communications are sent on behalf of the client's business and are governed by the client's own consent practices and applicable regulations including CAN-SPAM and TCPA.

Google & Meta Platform Data

As part of delivering paid advertising and SEO services, Clearpoint accesses data within Google Ads, Google Analytics, Google Business Profile, Meta Ads Manager, and related platforms on behalf of clients. The following applies:

  • All data within these platforms remains owned by the client and is governed by Google's and Meta's respective privacy policies and terms of service
  • Clearpoint accesses this data solely for the purpose of managing and optimizing campaigns as directed by the client
  • Clearpoint does not share platform data with any unauthorized third parties
  • Upon termination of services, Clearpoint will relinquish all access to client platform accounts
  • Clearpoint is not responsible for how Google or Meta collect, process, or use data through their own platforms independently of our management activities

Limitation of Liability

To the maximum extent permitted by applicable law, Clearpoint shall not be liable for any damages arising from:

  • Unauthorized access to or use of your information resulting from circumstances outside Clearpoint's reasonable control
  • Data breaches, losses, or disclosures originating from third-party platforms or tools used in connection with our services
  • Inaccurate information provided by the Client that results in unintended data collection or use
  • Any indirect, incidental, or consequential damages related to privacy matters, even if Clearpoint has been advised of the possibility of such damages

This limitation applies in conjunction with the Limitation of Liability provisions set forth in Clearpoint's Terms of Service.

Changes to This Policy

Clearpoint reserves the right to update or modify this Privacy Policy at any time. When changes are made:

  • The updated Policy will be posted to our website with a new effective date
  • Active clients will be notified via email of any material changes
  • Continued use of our services after the effective date of any modification constitutes acceptance of the revised Policy
